
LYNN, MASS. (WHDH) – Lynn police arrested two men following a fatal shooting in Lynn late Thursday night.
Brian Rivera, 36, is charged with murder, and Michael Constabile, 35, is charged with being an accessory after the fact.
According to authorities, police received a call reporting shots fired in the area of High Street at 11:23 p.m. Upon arrival, they located a 35-year-old male victim, who was unresponsive with “apparent gunshot wounds”.
Prosecutors say surveillance footage from cameras in the area led detectives to determine Rivera was the shooter.
“They look quite different on the video, so it’s very obvious to them who the shooter is,” said prosecutor Stefanie Stanbro.
“The victim was treated on scene and transported to Salem Hospital, where he was later pronounced deceased,” District Attorney Paul Tucker’s office said in a statement.
The victim’s name has not yet been released.
Both men pleaded not guilty in Lynn District court Friday and attempted to conceal their identities in court.
“I think that was something that was helpful for all the parties who are interested in the truth,” said Rivera’s attorney Murat Erkan. “By not having his face exposed to the public, again, so that there won’t be a case of mistaken identity.”
Erkan emphasized no one should jump to conclusions in the case.
“At the end of the day, the government has to approve the case beyond a reasonable doubt,” said Erkan. “We want to make sure that this evidence is not tainted by suggestive procedures.”
Rivera was ordered to be held without bail. Constabile was held on $100,000 cash bail.
