A lawyer representing the disgraced Hollywood mogul Harvey Weinstein is asking for a “fresh eye” in his upcoming retrial for rape and sexual assault.
The 72-year-old Weinstein appeared weak during a court hearing in Manhattan on Wednesday, just ahead of his retrial set for April 15. This comes after the state’s Court of Appeals overturned his 2020 convictions in New York, ruling that testimony from three women concerning uncharged allegations shouldn’t have been presented in the original trial.
Concerns around Weinstein’s health have been growing, especially since he underwent emergency heart surgery last year and is currently serving a 16-year sentence for unrelated rape charges in California. In spite of his condition, his lawyer stressed the need to reassess the case from new angles. Judge Curtis Farber reassured everyone that “everything is being done anew.”
Weinstein’s first conviction in New York involved charges related to raping an actress and forcing a production assistant to perform oral sex, which led to a 23-year prison sentence. However, Weinstein has always insisted that all sexual encounters were consensual. His legal team, including attorney Arthur Aidala, reiterated this claim during the hearing, emphasizing that “there is no victim” in these situations.
Weinstein’s dramatic fall from grace began with allegations that fueled the #MeToo movement back in 2017, with over 80 women accusing him of sexual misconduct. Well-known figures like Angelina Jolie and Gwyneth Paltrow spoke out against him. His career highlights include co-founding Miramax Films and producing celebrated films such as Pulp Fiction and Shakespeare in Love, which earned him an Academy Award.
