
The Tucker City Council at its March 10 meeting held a public hearing on an application to rezone three lots in order to develop four single-family homes.
The applicant, Shahidul Hai, wants to rezone 4166 and 4168 Chamblee Tucker Road and the rear portion of 3152 Westwood Drive from R-100 (Residential Medium Lot – 100) to R-75 (Residential Medium Lot – 75) in order to develop four single-family detached lots.
According to supporting documents regarding the rezoning, the existing parcel at 4166 Chamblee Tucker Road is .81 acres and the existing parcel at 4168 Chamblee Tucker Road is .7 acres. Combined, the two properties have a total of 199 feet of lot frontage. The parcel at 3152 Westwood Drive is .48 acres and has 128 feet of lot frontage.
Hai wants to rezone the two Chamblee Tucker Road parcels, as well as 5,183 square feet (.12 acres) of the Westwood Drive parcel in order to have additional acreage to develop four residential lots and the fifth lot needed for a detention facility and mail kiosk.
“The Westwood Drive parcel would remain compliant with R-100 dimensional requirements after the rear portion is rezoned and subdivided for this project,” the document said. “The incorporation of the Westwood Drive parcel will also provide access to the sewer line that runs along Westwood Drive as sewer is not available along this portion of Chamblee Tucker Road.”
Access to the proposed development would only be available from Chamblee Tucker Road. No connection is provided through the Westwood subdivision.
An additional 12,187 square feet would be required in order to develop this same project under R-100 zoning regulations, according to staff.
The Tucker city staff recommended approval with eight conditions, including ones limiting the number of homes in the subdivision, the removal of dead trees, shrubs, and vines during land development, landscape buffers, the installation of six-foot sidewalks, and other stipulations.
During the public hearing, nobody spoke in favor or in opposition to the rezoning, other than attorney Josh Mahoney, who was representing the developer. The matter will come before the council for a vote in April.
The council also heard, during public comments, a group of advocates for the construction of a 12-court pickleball complex at Tucker Recreation Center, who pushed the panel to make a decision sooner rather than later. Residents on nearby Morgan Road have been vocal in their opposition in previous public forums, citing noise concerns, traffic congestion, and the $3 million price tag.
In other action, the council approved a $92,000 contract to relocate playground equipment from Henderson Park near the Lake Erin dam restoration project to two new locations, Church Street Greenspace and one at the east side of Henderson Park.
According to staff supporting documents, the existing equipment was installed as part of the city’s effort to replace the outdated playgrounds at the city parks when they were acquired from DeKalb County in 2018.
The relocation project is funded as part of the Lake Erin dam project.
